With growing concerns over children's suggestibility and how it may impact their reliability as witnesses, there is increasing interest in determining the long-term effects of induced memories. The goal of the present research was to learn whether source misattributions found by Ceci, Huffman, Smith, and Loftus caused permanent memory alterations in the subjects tested. When 22 children from the original study were reinterviewed 2 years later, they recalled 77% of all true events. However, they only consented to 13% of (...) all false events, compared to the 22% false consent rate found by Ceci et al. . Additionally, while children remained accurate in their recall of true events , they “recanted” their earlier false consents 77% of the time, after the 2-year delay. Implications of these findings for child witnesses and the legal system are discussed. (shrink)

Companies that contribute to charitable organizations rightly hope that their philanthropic work will also be good for the bottom line. Marketers of good corporate conduct must be especially careful, however, to market such conduct in a morally acceptable fashion. Although marketers typically engage in mild deception or take artistic license when marketing goods and services, these sorts of practices are far more morally troublesome when used to market good corporate conduct. I argue that although mild deception is not substantially worrisome (...) with respect to the marketing of most goods and services, it is a far greater moral blunder to use such methods in the marketing of good corporate character. These erode trust and demonstrate alack of adequate respect for the moral good. In light of these concerns, I suggest that such practices must be re-examined when applied to the marketing of corporate character and good conduct. Finally, I develop a revised set of ethical guidelines that are needed in order to address the problems peculiar to the marketing of morally praiseworthy behavior. (shrink)

When one addresses boycotts, the efforts of the Montgomery bus boycotts to end segregation likely come to mind. However, the moral merits of a boycott are not always so clearly determined and how a company reacts to a boycott can have long lasting repercussions for its public image. In this article, I will examine a number of boycotts including boycotts by the American Family Association of both Ford and Proctor & Gamble based on their advertising venue choices. In a politically (...) and morally charged atmosphere, it can be difficult for companies to determine where their moral obligations lie while at the same time being mindful of the bottom line. I suggest a number of guidelines to aid in corporate moral decision making when faced with a boycott. (shrink)

Although the courts have ruled that companies are legal persons, they have not yet made clear the extent to which political free speech for corporations is limited by the strictures legitimately placed upon corporate commercial speech. I explore the question of whether or not companies can properly be said to have the right to civil free speech or whether corporate speech is always de facto commercial speech not subject to the same sorts of legal protections as is the right (...) to civil free speech. In the absence of clearly defined legal precedent, I emphasize moral reasons for determining the appropriate limits of corporate civil free speech. Appealing to arguments typically used to justify individual rights to civil free speech, I examine the extent to which this sort of justification may or may not be legitimately extended to corporations. I conclude that corporate rights to civil free speech must be restricted because granting rights of free speech to institutions may, in practice, undermine the moral rationale and practical feasibility of guaranteeing rights of civil free speech to individuals. Furthermore, I argue that granting corporations full rights to civil free speech will undercut attempts to develop good moral character in corporate institutions by undermining the efforts of watchdog organizations. In the wake of Citizens United v. the Federal Elections Commission, more companies are spending heavily on political speech, but the moral implications of doing so are not clear. Few business ethicists have directly addressed the moral legitimacy of corporate political speech and the conditions under which it may be morally permissible. My goal here is to outline the moral hazards associated with engaging in corporate political speech. I argue that whether one takes a narrow Friedman-style shareholder primacy view of (...) managerial duty, a broader stakeholder view, or an even more wide-ranging political corporate social responsibility view of the moral duties of business, various moral hazards must be taken into account in determining the moral legitimacy of corporate political speech. I discuss a number of moral hazards endemic to corporate political speech and suggest ways in which business practitioners might avoid those moral hazards. (shrink)

When the Federal Communications Commission considered revamping its policies, many political activists argued that media conglomerates had failed to meet their duties to protect freedom of speech. Moveon's dispute with CBS over its proposed Superbowl advertisement and Michael Moore's quarrel over distribution of his documentary, Fahrenheit 911, are cases in point. In matters of pure entertainment, the public expect companies to avoid offensive programming. The press, on the other hand, may well be forced to offend some audience members in order (...) to create a viable forum for political dissent. As journalism and entertainment are increasingly inter-linked, an in depth moral analysis of the media corporation and its obligations becomes increasingly important. I explore Kantian, Utilitarian, and Rawlsian analyses of corporate obligation in the aforementioned cases. I then examine whether or not these results suggest anything more generally about the sorts of mission statements and ethical policies that ought to be endorsed by media conglomerates and whether non-business institutions also require changes. Ultimately, I suggest that at a minimum, media institutions should view the duty to promote the representation of diverse views in a democracy as an imperfect moral and civic duty rather than making programming decisions solely by reference to profit. Ideally, greater access to media access should not be increased for the most powerful unless doing so at the same time increases free speech opportunities for those who currently have the least access. Recently, several articles have asserted that corporate social responsibility programs have gone too far and need to be reigned in. These critics have charged that corporate social responsibility is to be regarded with skepticism and that any changes in corporate accountability should be superficial at best. I will examine a␣number of these objections; I conclude that these critiques are largely ill founded, but that their increasing frequency in popular media is a cause for concern. I argue that these purported objections (...) are better understood as one part of a long-term cycle that generally accompanies positive moral change in institutions. Using the feminist movement as a touchstone, I examine the similarities between backlash against the movement for corporate accountability as compared to backlash against feminists. I␣also suggest ways in which successful strategies adopted by feminists could be used effectively to communicate the aims of those working to increase awareness of business accountability. (shrink)

As the efficiency and reach of global fishing has grown, overfishing has unwittingly undermined the industry’s future while at the same time depriving poor people of a dietary staple. Several problems that most concern the critics of globalization come into play: undermining the power of governments to protect their environments and citizens, an economic system that robs the poor and future generations of basic necessities, and market developments that undercut long term economic and environmental stability. I examine how creative institutional (...) measures could avert total collapse of ocean ecosystems despite the complexity of enacting marine ethics in a globalized economy. I look at companies that work with the Marine Stewardship Council’s criteria as well as more creative measures including revamped marketing and changes in how members of the industry work together in order to encourage long term environmental and economic sustainability. In May of 2009, the Stockholm Convention added nine chemicals to its list of banned or restricted chemicals. While some businesses may be tempted to see further limitations on chemical production of persistent organic pollutants as an inconvenient hindrance, I argue that business ought to see strengthened rules as an opportunity to improve efficiency and to become more competitive in the global market place both financially and ethically. By re-examining not only product design but also products purchased, every company can (...) reduce their ecological footprint at a molecular level. In this paper we review the factors alleged to be responsible for the creation of inaccurate reports among preschool-aged children, focusing on so-called "source misattribution errors." We present the first round of results from an ongoing program of research that suggests that source misattributions could be a powerful mechanism underlying children′s false beliefs about having experienced fictitious events. Preliminary findings from this program of research indicate that all children of all ages are equally susceptible to making source misattributions. Data from (...) a follow-up wave of data indicate that very young children may be disproportionately vulnerable to these kinds of errors when the procedure is changed slightly to create mental images more easily. This vulnerability leads younger preschoolers, on occasion, to claim that they actually experienced events that they only thought about. These preliminary findings are discussed in the context of the ongoing debate over the veracity and durability of delayed reports of early memories, repressed memories, dissociative states, and the validity risks posed by therapeutic techniques that entail repeated visually guided imagery inductions. Through a discussion of the work of Marie Cardinal and Annie Ernaux, this article aims to problematize the anglophone academic world's tendency to associate French feminisms predominantly with avant-garde or highly theoretical texts. The work of Ernaux and Cardinal is presented alongside a discussion of its reception by readers and critics in France, and by academics in English-speaking countries. The first part of the article identifies aspects of Ernaux's and Cardinal's works which cannot be encompassed within a critical framework based (...) on the dichotomy between naïve realism on the one hand and the politically and linguistically radical text on the other. Ernaux's plain language, for instance, is clearly very unlike the linguistic experimentation of ‘feminine writing’; nonetheless the emphasis on social class in her writing constitutes a political intervention which is at least equally valid. The reception study in the second part of the article provides further evidence of the relevance to gender politics in France of Cardinal's The Words to Say It (1975) and texts published by Annie Ernaux in the 1980s and 1990s. The ambivalent response of critics seems to indicate the troubling nature of writing which combines the codes of realism and autobiography (or autobiographical fiction in Cardinal's case) with the depiction of taboo subjects such as menstruation, or a daughter's response to her mother's debilitating illness and death. The article also charts the widespread popularity of these texts in France, particularly with women readers, and gives some examples of the pleasures described in letters to the authors. In conclusion, we argue that the ambivalent space between popular and high culture occupied (albeit differently) by Ernaux and Cardinal may be particularly effective in terms of gender politics, and that even in the late 1990s, the personal may be as political as ever. This is the first comprehensive study for nearly 200 years of what remains of the writings of the Presocratic philosopher Philolaus of Croton. These fragments are crucial to our understanding of one of the most influential schools of ancient philosophy, the Pythagoreans; they also show close ties with the main lines of development of Presocratic thought, and represent a significant response to thinkers such as Parmenides and Anaxagoras. Professor Huffman presents the fragments and testimonia with accompanying translations and introductory (...) chapters and interpretive commentary. He not only produces further argument for the authenticity of much that used to be neglected, but also undertakes a critique of Aristotle's testimony, opening the way for a quite new reading of fifth-century Pythagoreanism in general and of Philolaus in particular. Archytas of Tarentum is one of the three most important philosophers in the Pythagorean tradition, a prominent mathematician, who gave the first solution to the famous problem of doubling the cube, an important music theorist, and the leader of a powerful Greek city-state. He is famous for sending a trireme to rescue Plato from the clutches of the tyrant of Syracuse, Dionysius II, in 361 BC. This 2005 study was the first extensive enquiry into Archytas' work in any language. It (...) contains original texts, English translations and a commentary for all the fragments of his writings and for all testimonia concerning his life and work. In addition there are introductory essays on Archytas' life and writings, his philosophy, and the question of authenticity. Carl A. The Pythagorean Precepts by Aristotle's pupil, Aristoxenus of Tarentum, present the principles of the Pythagorean way of life that Plato praised in the Republic. They are our best guide to what it meant to be a Pythagorean in the time of Plato and Aristotle. The Precepts have been neglected in modern scholarship and this is the first full edition and translation of and commentary on all the surviving fragments. The introduction provides an accessible overview of the ethical system of the (...) Precepts and their place not only in the Pythagorean tradition but also in the history of Greek ethics as a whole. The Pythagoreans thought that human beings were by nature insolent and excessive and that they could only be saved from themselves if they followed a strictly structured way of life. Recently, the Pythagoreans have received rather more attention, both in their own right and as part of the developing picture of Presocratic thought, than they received for much of the twentieth century. Thanks to these studies, a new and more complicated picture is emerging. This article refines this picture critically examining Aristotle's claims about Pythagorean influence on Plato, along with the related question of who among early Greek thinkers actually counts as a Pythagorean. It provides a reminder that Aristotle's account (...) of the history of earlier thought is always a history of just a part of the philosophy of his predecessors, and makes clear that the eagerness with which some present-day scholars find Pythagorean influence on later thought may be misplaced. In this article I want to clarify the text of one of the short maxims assigned to Pythagoras in the ancient tradition, which are known as symbola or acusmata. Before I turn to the acusma in question, it is important to understand the context in which it appears. It occurs in Chapter 17 of Book 4 of Aelian's Historical Miscellany. Aelian's work was written in the early third century a.d. in Rome, and is a ‘miscellaneous collection of anecdotes and historical (...) material’. It consists of short chapters, usually a page or less long, that are for the most part independent of one another. Chapter 17 of Book 4 is about a page long and is devoted to the sayings and doings of Pythagoras. There is no particular connection between it and the surrounding chapters, and it is clearly meant to stand on its own. The preceding chapter tells us that if we went to Callias for guidance he would turn us into drinkers, … if to Alcibiades, arrogant cheats, if to Demosthenes, orators, … if to Aristides, just men, … if to Socrates, wise men. The following chapter recounts an anecdote about Plato's arrival in Sicily and his reception by the tyrant Dionysius the Younger. The chapter that I am concerned with, Chapter 17, begins by asserting that Pythagoras taught that his ‘lineage was superior to that of ordinary mortals’. This is followed by a list of superhuman acts and traits of Pythagoras, for example his ability to be in Metapontum and Croton at the same time and his golden thigh. The second two-thirds of the chapter are then devoted to the miscellaneous teachings of Pythagoras. Most of these take the form of the brief taboos and maxims known elsewhere as symbola or acusmata, among which is the text on which I want to focus here. (shrink)

In a long note in his epoch-making book on ancient Pythagoreanism Walter Burkert raised some grave doubts about the authenticity of Archytas Fr. 1 which have recently been challenged in an article by A. C. Bowen. In this paper I have two goals. First, I will evaluate Burkert's doubts and the success of some of Bowen's arguments against them. Second, I will present a further consideration that both clarifies the text of the fragment and also removes the most serious problem (...) raised by Burkert. The upshot of both these points is to increase the likelihood that the fragment is authentic. I reproduce the text of just the first part of the fragment as given in DK followed by the text as it appears in the two primary sources, Nicomachus and Porphyry. (shrink)
